These Terms explain the rules for using JobSpidey, how subscriptions and credits work, what you can expect from our AI-assisted tools, and the responsibilities that apply to both sides.

1. Acceptance of these Terms

These Terms & Conditions govern your access to and use of JobSpidey, including jobspidey.com, our applications, dashboards, billing flows, support channels, and related services. By creating an account, buying credits, starting a subscription, using Google sign-in, or otherwise using the service, you agree to these Terms.

If you use JobSpidey for or on behalf of a business, you confirm that you have authority to bind that business to these Terms. If you are under the age of majority where you live, you may only use the service with the involvement and consent of a parent or legal guardian.

2. What JobSpidey provides

JobSpidey provides software tools that help users manage a job search, discover publicly available job listings, prepare resumes and cover letters, track applications, and manage credits or subscriptions. JobSpidey is a software platform. It is not an employer, recruiter, staffing agency, law firm, or immigration adviser.

We may improve, change, pause, or remove features from time to time. We may also add limits, safeguards, or eligibility requirements where needed for reliability, security, legal compliance, fraud prevention, or fair usage.

Some parts of the service depend on third-party job boards, cloud infrastructure, payment providers, email systems, AI services, and optional browser-extension integrations. Those dependencies can change or fail without notice, and that may affect searches, generation, billing, notifications, availability, or speed.

3. Accounts and account security

You must provide accurate, current, and complete information when creating or maintaining an account. You are responsible for keeping your login credentials secure and for all activity that happens under your account.

You must promptly tell us if you believe your account has been accessed without permission. We may suspend or restrict accounts where we reasonably believe there has been fraud, abuse, security risk, or a breach of these Terms.

  • You may not share your account in a way that defeats plan, credit, or security controls.
  • You may not create accounts using false identities, disposable identities to abuse promotions, or credentials you are not authorised to use.

4. Your materials and permissions

You keep ownership of the resumes, cover letters, employment history, profile information, and other content you upload or submit to JobSpidey. However, you give us a limited, non-exclusive permission to host, copy, process, reformat, analyse, store, and transmit that material as needed to operate, secure, improve, and support the service for you.

You confirm that you have the right to upload and use the material you submit. You must not upload content that infringes another person's rights, contains unlawful material, or includes personal data you are not allowed to process or disclose.

5. AI-generated content and limited employment guarantee

JobSpidey uses automated systems and AI models to help prepare resumes, cover letters, and related application materials. AI output can be incomplete, outdated, inaccurate, biased, or unsuitable for a particular role. You are responsible for reviewing all outputs before using or submitting them.

To generate requested outputs, JobSpidey may send limited portions of your resume, profile details, job-search inputs, and relevant job-description content to third-party AI providers. We aim to send only the information reasonably necessary to generate the application materials you request.

We do not sell your personal information and we do not profit by selling resume or profile data. However, once information is transmitted to third-party AI providers, their own terms, privacy practices, retention rules, abuse-monitoring systems, legal obligations, and internal model-development practices may also apply. This may include provider use of submitted content for service improvement, evaluation, training, or similar internal purposes, and we do not fully control those third-party systems.

Except for the limited Ultra Job Guarantee described in these Terms, JobSpidey does not guarantee job matches, application relevance, interview invitations, visa outcomes, regulatory compliance, or employment offers. Nothing on the service is legal, immigration, tax, accounting, or professional career advice.

We do not promise that any resume, cover letter, or application output will be satisfactory, employer-ready, interview-winning, ATS-optimised, free from formatting issues, or fit for your intended purpose.

  • You are responsible for the final version of every document you send to an employer.
  • You are responsible for checking dates, qualifications, claims, names, compensation references, and factual statements before submission.
  • You must not use the service to create misleading, false, defamatory, or unlawful application materials.
  • If you do not want certain sensitive information processed by third-party AI providers, do not include it in the material you submit to JobSpidey.

6. Third-party job listings and external services

JobSpidey may surface or link to job listings, employer sites, payment processors, authentication providers, analytics tools, storage providers, or other third-party services. We do not control third-party websites, job boards, or employers, and we are not responsible for their content, availability, decisions, security, or terms.

Job listings may change, expire, redirect, be removed, or contain inaccurate details. A listing appearing in JobSpidey does not mean we endorse the employer or guarantee that the role is genuine, open, lawful, or suitable for you.

Third-party sites may also block, limit, or alter access methods at any time. If a source site throttles access, presents anti-bot challenges, changes its markup, or removes content, JobSpidey may temporarily return fewer jobs, no jobs, or interrupted results for that source.

7. Plans, credits, subscriptions, and billing

Some features are paid. Pricing, quotas, credit amounts, billing intervals, and plan descriptions are shown on the site at the time of purchase. You authorise us and our payment providers to charge the payment method you provide for the plan, top-up, tax, and related charges you select.

Paid subscriptions renew automatically until cancelled. By starting a subscription, you agree to the recurring billing terms presented at checkout. We aim to make cancellation straightforward through the billing tools we provide.

  • Free or promotional starter credits may be offered to eligible new accounts once, unless we clearly say otherwise.
  • Monthly plan entitlements are subject to the plan's daily quota and monthly quota shown on the site.
  • Extra purchased credits are used after the daily quota is exhausted and currently expire 1 year after purchase unless we clearly state otherwise.
  • Subscription changes may take effect immediately or at the next renewal date, and any prorations or credits are determined by the payment processor and the active plan settings at that time.
  • If you cancel a subscription, it will usually remain active until the end of the current paid billing period unless applicable law requires otherwise or we expressly state otherwise.
  • Unless we clearly state otherwise, unused plan entitlements do not roll over and prices may change prospectively for future billing periods.
  • Except where required by law or stated in a written offer, purchases are non-refundable and credits are non-transferable, non-redeemable for cash, and may only be used within JobSpidey.

8. Ultra Job Guarantee

The Ultra Job Guarantee is a limited refund review program for eligible Ultra members only. It applies only when your Ultra purchase or renewal starts on or after the posted guarantee launch date.

To qualify for review, you must keep an Ultra membership active for 6 consecutive billing months, mark at least 200 applications as applied in JobSpidey during each guarantee month, mark at least 1,200 total applications as applied during the 6-month guarantee period, submit a refund request within 30 days after the guarantee period ends, and not have received a job offer during the guarantee period.

For monthly Ultra, guarantee months follow your paid Stripe subscription billing periods. For annual Ultra, the guarantee uses six monthly windows starting from the annual Ultra period start.

Refund requests are manually reviewed. Meeting the tracking thresholds makes you eligible for review; it does not create an automatic refund, automatic Stripe action, or automatic account credit.

  • Disqualifiers include cancelling, pausing, downgrading, payment failure, losing Ultra status, missing 200 marked-applied applications in any guarantee month, misrepresenting application activity, employment status, job offers, or account usage, abusing the service, or violating these Terms.
  • Only applications marked as applied in JobSpidey count toward the threshold. Applications that are not tracked in JobSpidey, or no longer have a counted status at review time, may not count.
  • The refund is limited to Ultra membership fees paid for the qualifying 6-month guarantee period. For Ultra Annual, the refund is the six-month equivalent value, not necessarily the full annual payment.
  • Taxes, payment processing fees, currency conversion costs, top-ups, credits, third-party costs, and amounts not tied to the qualifying Ultra membership period may be excluded where permitted by law.

9. Job Hunt Challenge, leaderboards, squads, shares, and referrals

The Job Hunt Challenge is an optional community and challenge feature. If you join, you choose a nickname and decide whether to appear on public leaderboards. Public Challenge surfaces are designed to show nickname-only progress, not your real name, email, employer names, job titles, resume text, application notes, or private account details.

Challenge leaderboards, badges, streaks, squads, and share pages are based on activity recorded inside JobSpidey, such as applications marked applied and completed practice interview time. Hired celebrations are self-marked by the user and are not verified employment claims by JobSpidey.

Referral rewards may be offered when an invited user signs up with a valid referral code and later completes real activity, such as first marking an application as applied. Referral amounts, caps, eligibility checks, and abuse limits may change, and we may deny or reverse rewards for fraud, duplicate accounts, fake activity, or attempts to manipulate the program.

Challenge achievements may grant one-time promotional credits when measurable effort milestones are unlocked. Self-marked hired celebrations, group joins, referrals, and similar vanity milestones are badge-only in the achievement system. Achievement credit amounts, eligibility checks, and availability may change, and we may deny or reverse credits for fake activity, duplicate accounts, abuse, or attempts to manipulate the Challenge.

  • Invite-only squads are visible to squad members and admins. Squad join codes should be shared only with people you want in that squad.
  • Public Challenge share pages may be viewed by anyone with the link and may be indexed or reshared outside JobSpidey.
  • You must not use Challenge nicknames, squads, share pages, referrals, or hired celebrations to harass, impersonate, mislead, spam, or disclose another person's private information.

10. Affiliate Program

The JobSpidey Affiliate Program is an application-only marketing program for approved creators, salespeople, and partners. Approved affiliates may receive a personal link and discount code that can attribute eligible JobSpidey purchases to them.

Approved affiliate codes may provide customers with a 10% discount and may generate a 25% affiliate commission on attributed subscriptions, subscription renewals, and credit top-ups. Commission is calculated on the actual paid amount after the affiliate discount, excluding refunded, disputed, reversed, tax, payment-fee, currency-conversion, or third-party amounts where applicable.

Affiliate commissions are tracked through JobSpidey's systems and Stripe payment events. Payouts are normally reviewed monthly after a minimum 30-day refund/dispute window and are subject to minimum payout thresholds by currency. Stripe Connect Express is the preferred payout method where available, and manual payout fallback may be used at our discretion.

Ultra subscription commissions may remain pending or held while the referred customer is still on track for the Ultra Job Guarantee or is eligible for guarantee review. If a customer refund, dispute, chargeback, or guarantee refund occurs after a commission has been paid, JobSpidey may offset that amount against future affiliate payouts.

  • Affiliate approval, commission eligibility, payout timing, payout method, and continued participation are not guaranteed.
  • Affiliates may use their own affiliate code for their own purchases unless we later identify fraud, abuse, or manipulation.
  • Affiliates must not make misleading employment, refund, earnings, discount, pricing, or guarantee claims, and must comply with advertising, disclosure, spam, and consumer-protection rules that apply to their promotions.
  • We may reject, suspend, revoke, withhold, reverse, or adjust affiliate commissions for fraud, duplicate accounts, fake purchases, misleading promotion, refund/dispute risk, abuse of regional pricing, violation of these Terms, or operational error.

11. Acceptable use

You must use the service lawfully and responsibly. You must not misuse the platform, other users, employers, or third-party services connected to the platform.

  • No unlawful, fraudulent, deceptive, harassing, or abusive use.
  • No unauthorised access, probing, interference, rate-limit evasion, or attempts to bypass security or billing controls.
  • No uploading malware, harmful code, or content that could damage systems or third parties.
  • No resale, sublicensing, or commercial exploitation of the service except where we have agreed to it in writing.
  • No use of JobSpidey in a way that infringes intellectual property, privacy, confidentiality, employment, or data protection rights.
  • No use of the service to mass-submit false, misleading, or spam applications, or to impersonate another person or business.

12. Availability, maintenance, and changes

We work to keep the service available, but we do not promise uninterrupted or error-free operation. We may perform maintenance, deploy updates, change infrastructure, rotate providers, introduce feature flags, or restrict access where needed for security, abuse prevention, capacity, or legal compliance.

You are responsible for keeping your own copies of any material that matters to you, including master resumes, generated documents, and application records. JobSpidey is not a guaranteed archival or backup service.

We are not responsible for downtime, delays, failed searches, failed generations, notification issues, corrupted output, missing third-party content, or loss of access caused by third-party outages, browser changes, source-site blocking, internet failures, force majeure events, or events outside our reasonable control.

We may modify these Terms from time to time, including as the service evolves, providers change, laws change, or our operational practices change. When we make material changes, we will post an updated version on the site and update the "Last updated" date. Your continued use after the updated Terms take effect means you accept the revised Terms.

13. Intellectual property

The JobSpidey service, software, branding, interfaces, workflows, and site content are owned by us or our licensors and are protected by intellectual property laws. These Terms give you a limited, revocable, non-transferable right to use the service for its intended purpose.

Except as allowed by law, you must not copy, modify, distribute, sell, reverse engineer, or create derivative works from the service or its source materials without our prior written permission.

14. Privacy and data handling

We collect and use personal information to run the service, secure accounts, process payments, generate documents, provide support, and improve product performance. Where applicable, we aim to handle personal information consistently with relevant privacy and data protection laws, including the New Zealand Privacy Act 2020.

You acknowledge that some of your content may be processed by trusted service providers used to operate JobSpidey, such as authentication, email, storage, billing, analytics, and AI infrastructure providers.

Where AI providers are used, we aim to transmit only the content reasonably necessary to generate the requested output. Those providers may still retain or review prompts and outputs under their own published policies for safety, abuse monitoring, security, legal compliance, service operation, or related purposes.

15. Consumer rights and mandatory protections

Nothing in these Terms excludes, restricts, or overrides any rights or remedies you have under laws that cannot legally be excluded, including mandatory consumer protection, privacy, or unfair contract laws that apply to you.

If any part of these Terms conflicts with a mandatory legal protection, the mandatory protection will apply to that extent and the rest of the Terms will remain in effect.

16. Your responsibility for misuse and third-party claims

To the maximum extent permitted by law, you are responsible for claims, losses, costs, and expenses that arise from your misuse of the service, your content, your breach of these Terms, or your violation of another person's rights.

This includes, for example, claims based on misleading application content you submit, unlawful use of personal information you upload, or abusive or unauthorised use of the platform.

17. Disclaimers and limitation of liability

To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis. We do not make warranties that the service will be uninterrupted, secure, accurate, fit for a particular purpose, or free from errors, third-party blocking, or compatibility issues.

Without limiting the previous sentence, we specifically disclaim any warranty or representation about the quality, adequacy, merchantability, fitness, effectiveness, accuracy, or suitability of any generated resume, cover letter, job suggestion, salary estimate, application insight, or workflow recommendation.

To the maximum extent permitted by law, JobSpidey and its affiliates, officers, employees, and contractors are not liable for any indirect, incidental, consequential, special, exemplary, or loss-of-data damages, or for any loss of profits, opportunities, goodwill, or employment outcomes arising from or related to your use of the service.

To the maximum extent permitted by law, our total aggregate liability for claims arising out of or relating to the service will not exceed the greater of the amount you paid us for the service in the 12 months before the event giving rise to the claim, or NZD $100.

18. Suspension and termination

You may stop using the service at any time. We may suspend, restrict, or terminate access where we reasonably believe that doing so is necessary to protect the service, other users, employers, third parties, or our legal and commercial interests.

Termination does not affect rights or obligations that by their nature should continue, including payment obligations, liability limits, ownership provisions, dispute clauses, and any accrued rights or remedies.

19. Governing law and disputes

These Terms are governed by the laws of New Zealand, except to the extent that mandatory consumer protection laws in your home jurisdiction apply and cannot lawfully be excluded.

Where permitted by law, you and JobSpidey submit to the non-exclusive jurisdiction of the courts of New Zealand for disputes arising out of or relating to these Terms or the service.
